Greyhawk Equity Partners Limited Partnership

On February 8, 2011, an Order was made by the Honourable Mr. Justice Morawetz pursuant to section 101 of the Courts of Justice Act, R.S.O. 1990, c. C.43 (the “Initial Order”), as amended appointing A. Farber & Partners Inc. ("Farber") as receiver (the “Receiver”), without security, of all the assets, undertakings and properties of Greyhawk Equity Partners Limited Partnership (Millenium) (“Greyhawk LP") and Greyhawk Equity Partners Ltd. (“Greyhawk GP”, and together with Greyhawk LP, “Greyhawk”) acquired for, or used in relation to business carried on by Greyhawk. 

Subsequently, on February 17, 2011, Farber’s role as Receiver was extended to include all the assets, undertakings and properties of Greyhawk Equity Partners Limited Partnership and Bedford and Associates Research Group Inc. pursuant to an Order of the Honourable Mr. Justice Morawetz.

In addition, the relief granted in the Initial Order was extended until April 18, 2011 or such later time as determined by further Order of this Court.

On April 18, 2011, the Court ordered a further extension of the Receivership until June 17, 2011.  Revisions to the Initial Order dated February 8, 2011 and the Continuing Order dated February 17, 2011 were sought such that the Plaintiffs' legal fees are to paid on a full indemnity basis by the Receiver from the Estate, subject to review by the investors within ten days of the conference call scheduled for April 27, 2011.

On February 14, 2012, the relief granted in the Initial Order and continued in the subsequent Orders dated February 17, 2011, April 18, 2011, June 1, 2011 and October 4, 2011 was extended and will continue to June 30, 2012.
