Neudoerffer Truck Supply Inc.
On March 2, 2011, Neudoerffer Truck Supply Inc. (the "Company") filed a Notice of Intention to Make a Proposal ("NOI") pursuant to Section 50 of the Bankruptcy and Insolvency Act (the "BIA"). A. Farber & Partners Inc. ("Farber") was appointed Proposal Trustee.
The Company obtained a Court extension to file the Proposal by May 16, 2011. During this time, the Company actively sought an investor, a partner and/or a purchaser of the business in order to restructure the Company and to file a viable proposal.
The Company attended Court on May 16, 2011 and obtained Court approval for a sale of the inventory and the accounts receivable to a third party and the immediate foreclosure of the remaining assets in satisfaction of the remaining debt owed to secured creditors that are related to the Company. There were no assets left, so the Company was unable to file a viable Proposal; accordingly, the Company was automatically deemed bankrupt on May 17, 2011. As there are no assets available to the estate, there will be no funds available for the unsecured creditors.
