Trevelyan Limited

On July 22, 2011, Trevelyan Limited ("Trevelyan" or the "Company") filed a Notice of Intention to File a Proposal ("NOI") pursuant to Section 50.4 of the Bankruptcy and Insolvency Act ("BIA").  A. Farber & Partners Inc. ("Farber") was appointed Trustee in the Proposal of the Company.

The effect of the NOI was that it provided an initial 30-day stay over all creditors staying all amounts outstanding effective July 22, 2011 (i.e., all amounts outstanding at July 22, 2011 and prior), while the Company formulated a Proposal to be presented to its creditors.

On August 19, 2011, the Proposal was filed with Farber and packages were mailed to all known creditors.  This package contained:

  1. Notice to Creditors of Proposal;
  2. The Proposal;
  3. The Trustee’s Report on the Proposal;
  4. The Statement of Affairs of the Company;
  5. List of creditors with claims of $250 or more;
  6. Proof of Claim Form; and,
  7. Voting Letter.

The First Meeting of Creditors was held on Friday, September 9, 2011 at 10:00 a.m. at the Yorkland Days Hotel & Conference Centre, located at 185 Yorkland Boulevard in the city of Toronto, Ontario. At the meeting, the creditors rejected the Proposal presented by Trevelyan Limited and, accordingly, pursuant to subsection 57(a) of the BIA, the Company was deemed to have made an assignment in bankruptcy.  A copy of the Certificate of Assignment is posted below.

If you have already completed and submitted a Proof of Claim for the Proposal, it will be recorded as submitted for the Bankruptcy proceeding unless otherwise notified.
